Information on Deputies

INFORMATION ON DEPUTY ENFORCEMENT AGENTS

Every enforcement agent shall be obliged, within 30 days since the day of commencement of work, to submit a proposal to the Minister of Justice for appointing a deputy enforcement agent.

 

  • A person working in the enforcement agent’s office, who shall meet the following conditions, may be appointed as a deputy enforcement agent:

 

  1. to be a citizen of the Republic of Macedonia – verified with a Citizenship Certificate;
  2. to be professionally capable – verified with a Professional Capability Certificate;
  3. to have general health capability – verified with a Medical Certificate on the General Health Condition, issued by a competent health care institution working in the field of occupational medicine, issued less than 12 months before the submission day;
  4. to be a graduate law student with completed four years of high education in legal studies or a graduate law student with acquired 300 credits according to the European Credit Transfer System (ECTS) – verified with a Faculty of Law Degree;
  5. to have at least five years of working experience in legal matters or three years in enforcement affairs – verified with a Certificate issued by an employer, i.e. Certificate issued by the Chamber of Enforcement Agents of the Republic of Macedonia in accordance with the records of employees in the enforcement agent’s office;
  6. to have passed the Enforcement Agent Exam according to the program prescribed by the Minister of Justice – verified with a Certificate of Passed Enforcement Agent Exam
  7. to be fluent in Macedonian language – verified with completed education in the Republic of Macedonia, if, however, the person has completed his education abroad, he is required to submit a Certificate of Active Knowledge and Usage of the Macedonian Language issued by the Faculty of Philology within Ss. Cyril and Methodius University – Department of Macedonian Language and South-Slavic Languages;
  8. not to be convicted with a final court decision of unconditional sentence imprisonment of more than six months, verified with a Certificate of Non-Conviction;
  9. not to be imposed a sentence “prohibition against performing the duties of the enforcement agents” – verified with a Certificate that the person has not been imposed a sentence “prohibition against performing the duties of the enforcement agents.

 

  • All documents to be submitted to the Ministry of Justice shall be original documents or copies verified by a notary public.
  • Required documents for registration in the Directory of Deputy Enforcement Agents kept by the Chamber of Enforcement Agents of the Republic of Macedonia shall be as follows:
  1. Decision issued by the Minister of Justice on the appointment of a deputy enforcement agent
  2. M1 and M2 forms – copy
  3. Two color photos 2.5 x 3 cm
  4. CV

 

Remark:

The identification card for the Deputy Enforcement Agent shall be issued by the Ministry of Justice, upon submission of two color photos 2.5 x 3 cm by the deputy enforcement agent to the Ministry of Justice.

 

Note:

Before the number of persons with passed Enforcement Agent Exam is doubled, compared with the number of enforcement agents determined for each region of the Basic Courts, other enforcement agent can be appointed as a deputy enforcement agent.

A dismissed enforcement agent who has meet the conditions for retirement can be appointed as a deputy to the enforcement agent, but his mandate may last not longer than a year.
